I would say no, unless the summon time is instant. Smith has had time to prepare for this because he was betrayed and murdered. It's a little weird to start talking about fairness now.

You act so surprised about the betrayal when it was in Smith's character to betray his own team as well. There is no fair in war.

But of course Smith is not upset at his actually team mate who did betray him all we did was help me and we wouldn't have done anything without colonol saying so. That makes perfect sense. That's "Fair"
