In Legacy both sides agreed to prep.

Once the challenge has been acknowledged, players agree on when to start the fight. A player may have up to seven days from the initial challenge in order to prepare themselves for the fight, but it may not be delayed any longer unless agreed upon by both players. Players may wish to post before the fight begins, setting up the fight in-character, but these posts will not count towards the fight itself. 

When it says that 'you may' have up to seven days, that is in no way saying that, 'you get seven days regardless of anything else because I say so and that is the rules'.

It is saying that the players may decide on anywhere between 1 - 7 days of preparation for said fight, unless agreed upon by both parties.

party one may want 1 day, party 2 may want all 7, then they come to an agreement in the middle based on that situation.
