From This post All primes that were in the graveyardverse are not anymore, they were all teleported to the nexus.

Anyone who is in the nexus, is allowed to challenge whoever is in the nexus. Threfore, since Thaal is in the nexus, he is allowed to challenge sasuke if he wishes.
