Metroid 2 - Omni - 08-08-2016 The long-awaited Metroid 2 remaster, "Another Metroid 2 Remake", is finally out: http://metroid2remake.blogspot.co.uk/ It's awesome and very polished. RE: Metroid 2 - Omni - 08-09-2016 Well, it's an absolute travesty for people not to be able to play a remake that is the closest thing to an official release we've had in years. It's a quality remaster. Shouldn't be too hard to get ahold of even though it's been taken down. Also I have skype. And yeah, the files got taken down but the creators have NOT received a ceast and desist. This is a good post about it from reddit: "It uses no art from Nintendo. The sprites, music, maps, and code are all fan-created. The logic was reverse-engineered from interaction with the original, and with other Metroid titles - rather than via disassembly, which would constitute infringing reverse-engineering. This game uses literally none of Nintendo's IP. It is a derivative work, and should be covered wholly under fair use. To put it another way, this is like a record company filing a DMCA because you played their song - on your own guitar - in your YouTube video. Precedent on music covers is pretty clear: they're OK - covered under fair use - and consent is not required, so long as no money changes hands for the cover. This is analogous. This is almost exactly analogous. It's a hell of a lot more effort, but it's analogous nonetheless. The best legal action Nintendo has for is trademark infringement - for using the Metroid name and the names of Metroid creatures, and of Samus Aran. However, the DMCA protects copyright - and specific to this case, it addresses the unlawful service of Nintendo's copyrighted material - which this is very clearly not - by unauthorized third parties. It does not have provisions for protecting trademark; they would lose if this came to court - which I maintain, it very much should. something like this would end in disaster You're right; the right judge, favorable to NoA and corporate interests in general, and it could end in disaster. Or it might end in a more concrete precedent for fair use. Or, if the judge throws the case out because Nintendo used the wrong process, nothing would happen (except, you know, it would be no longer legally gray just to play the game)."
